1. Acceptance

1.1 These Terms apply to your use of the ATSR website, including all pages, forms, booking tools, downloads, content and online services.

1.2 By using the website, you agree to these Terms.

1.3 If you do not agree, you must stop using the website.

2. About ATSR

2.1 ATSR provides RPL pathway facilitation, evidence-support, consulting, administrative coordination and referral services.

2.2 ATSR is not a Registered Training Organisation.

2.3 ATSR is not a CRICOS provider.

2.4 ATSR does not deliver nationally recognised training, does not assess competency, and does not issue AQF certification documentation.

2.5 RTOs are responsible for enrolment, assessment, competency decisions, complaints, appeals, compliance and issuing any AQF certification documentation.

3. Website information is general only

3.1 The website contains general information about ATSR’s services, RPL pathways and related topics.

3.2 The website is not professional advice, legal advice, migration advice, licensing advice, employment advice, financial advice or RTO assessment advice.

3.3 You must obtain advice from a qualified professional or relevant authority before relying on information for licensing, migration, employment, industry registration or overseas recognition.

4. No guarantee of outcome

4.1 ATSR does not guarantee that you will receive a qualification, statement of attainment, competency outcome, enrolment, job, promotion, licence, registration, migration outcome or other benefit.

4.2 Any RPL or training outcome depends on the relevant RTO, your evidence, applicable requirements and assessment decisions.

4.3 Any timeframe stated on the website is an estimate only unless ATSR expressly states otherwise in a signed agreement.

5. VET course information

5.1 Where the website refers to a specific VET course, qualification, skill set or unit, ATSR will use reasonable efforts to identify the relevant issuing RTO where required.

5.2 Course availability, RTO scope, fees, entry requirements, assessment requirements and completion timeframes may change.

5.3 You should verify current course information with ATSR and the relevant RTO before making a decision.

6. Online enquiries and forms

6.1 Submitting an enquiry, booking a consultation or uploading documents does not create an RTO enrolment.

6.2 Submitting an enquiry does not guarantee that ATSR will accept you as a client.

6.3 Submitting an enquiry does not guarantee that an RTO will accept your file or issue an outcome.

6.4 You must provide accurate, complete and lawful information.

6.5 You must not upload false, misleading, forged, altered, offensive, unlawful or third-party material that you have no right to provide.

7. Client agreements prevail

7.1 If you become an ATSR client, your signed client agreement, quote, fee schedule or special terms will govern the paid services.

7.2 These Website Terms do not override your non-excludable rights under the Australian Consumer Law.

8. Fees and payments

8.1 Website prices, if displayed, are indicative unless stated as a binding quote.

8.2 ATSR may change website prices at any time.

8.3 A price change does not affect a signed agreement unless that agreement allows the change.

8.4 You must review all fee and refund terms before making payment.

9. Consumer rights

9.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.

9.2 To the extent permitted by law, ATSR limits its liability for services to resupplying the services or paying the cost of resupply.

10. Privacy

10.1 ATSR handles personal information in accordance with its Privacy Policy.

10.2 By using the website or submitting information, you consent to ATSR collecting, using and disclosing your information as described in the Privacy Policy.

10.3 You must not submit another person’s personal information unless you have authority to do so.

11. Marketing communications

11.1 ATSR may send marketing communications where it has consent or is otherwise permitted by law.

11.2 You may unsubscribe from marketing communications at any time using the unsubscribe method provided or by contacting ATSR.

11.3 Service, payment and compliance communications are not marketing communications and may still be sent where necessary.

12. Cookies and analytics

12.1 The website may use cookies, pixels, analytics tools and similar technologies.

12.2 These tools may collect information about your device, browser, pages viewed, forms used, approximate location and interactions with the website.

13.2 You may view website content for personal and non-commercial use.

13.4 All ATSR names, logos and branding remain ATSR’s property.

14.1 You must not misuse the website.

14.2 You must not:

  • (b) attempt unauthorised access;
  • (c) upload malware;
  • (d) scrape or harvest data;
  • (e) impersonate another person;
  • (f) submit misleading information;
  • (g) infringe intellectual property rights;
  • (h) breach privacy rights;
  • (i) use the website for unlawful conduct; or
  • (j) overload or disrupt the website.

15. Third-party links

15.1 The website may link to third-party websites, including RTOs, regulators, payment providers, booking tools and social media platforms.

15.2 ATSR does not control third-party websites.

15.3 ATSR is not responsible for third-party content, availability, security, privacy practices or services.

15.4 You use third-party websites at your own risk.

16. Website availability and security

16.1 ATSR aims to keep the website available and secure, but does not guarantee uninterrupted, error-free or virus-free access.

16.2 ATSR may suspend, withdraw, update or change the website at any time.

16.3 You are responsible for your own device security, internet connection and backups.

17. User content

17.1 If you submit content through the website, you grant ATSR a licence to use, copy, store, disclose and process that content for the purpose for which it was submitted and related business, compliance and service purposes.

17.2 You warrant that you have the right to submit that content.

17.3 ATSR may remove or refuse user content at its discretion.

18. Disclaimer

18.1 The website is provided on an “as is” and “as available” basis.

18.2 ATSR uses reasonable efforts to keep information accurate, but does not warrant that all information is complete, current or suitable for your particular purpose.

18.3 You must not rely solely on website information when making education, employment, licensing, migration or financial decisions.

20.2 The updated Terms apply from the date of publication unless stated otherwise.

20.3 Changes do not retrospectively alter a signed client agreement unless that agreement permits it.

21. Governing law

21.1 These Terms are governed by the laws of New South Wales.

21.2 You submit to the non-exclusive jurisdiction of the courts of New South Wales and Commonwealth courts exercising jurisdiction there.
