How ATSR collects, holds, uses and discloses personal information

1. Purpose

1.1 This Privacy Policy explains how ATSR collects, holds, uses and discloses personal information.

1.2 ATSR has drafted this policy to align with the Australian Privacy Principles where they apply and as a matter of good privacy practice.

1.3 This policy applies to clients, prospective clients, website users, agents, contractors, business contacts and other persons whose information ATSR handles.

2. ATSR’s role

2.1 ATSR provides RPL pathway facilitation, evidence-support, consulting, administrative coordination and referral services.

2.2 ATSR is not an RTO and does not issue qualifications.

2.3 ATSR may disclose personal information to RTOs and other providers so they can consider enrolment, assessment, RPL, training, complaints, appeals, compliance and certification matters.

3. Types of personal information we collect

3.1 ATSR may collect identity and contact information, including name, date of birth, address, email, phone number and emergency contact details.

3.2 ATSR may collect education and training information, including qualifications, transcripts, certificates, statements of attainment, training history and language needs.

3.3 ATSR may collect employment and skills information, including resumes, job titles, duties, employer details, references, work samples, portfolios, photographs, videos, licences and industry experience.

3.4 ATSR may collect identity verification information, including passport, driver licence, Medicare card, visa information or other identification documents where needed.

3.5 ATSR may collect USI-related information where required for RTO referral or enrolment.

3.6 ATSR may collect payment and transaction information, including invoices, receipts, payment status and refund records.

3.7 ATSR may collect communications information, including emails, SMS, call notes, call recordings where lawful, chat messages, complaints, feedback and support requests.

3.8 ATSR may collect technical information, including IP address, device information, browser type, website usage data, cookies, analytics and online form activity.

3.9 ATSR may collect sensitive information where reasonably necessary, including health information, disability information, language support needs, criminal history information or membership of professional or industry bodies.

3.10 ATSR will collect sensitive information only with consent or where otherwise permitted by law.

4. How we collect information

4.1 ATSR may collect information directly from you.

4.2 ATSR may collect information through website forms, phone calls, emails, SMS, online booking tools, document uploads, meetings, social media, payment systems and client portals.

4.3 ATSR may collect information from agents, referral partners, employers, referees, RTOs, contractors, assessors, service providers and publicly available sources.

4.4 ATSR may collect information from another person if you authorise that person to provide it.

4.5 ATSR may collect information automatically through cookies, analytics tools and similar technologies.

5. Why we collect information

5.1 ATSR collects personal information to provide services and manage its business.

5.2 Purposes include:

  • (a) responding to enquiries;
  • (b) assessing whether ATSR can assist you;
  • (c) providing RPL pathway facilitation;
  • (d) reviewing your Candidate File for completeness;
  • (e) helping organise Evidence;
  • (f) referring information to RTOs or other providers;
  • (g) managing client relationships;
  • (h) processing payments and refunds;
  • (i) verifying identity;
  • (j) communicating with you;
  • (k) sending service updates;
  • (l) managing complaints;
  • (m) complying with legal and regulatory obligations;
  • (n) preventing fraud and academic misconduct;
  • (o) protecting ATSR, RTOs and clients;
  • (p) improving services and website performance;
  • (q) training staff and contractors;
  • (r) marketing ATSR services where permitted; and
  • (s) obtaining professional advice.

6. Consequences if information is not provided

6.1 You do not have to provide personal information.

6.2 If you do not provide information requested by ATSR, ATSR may be unable to respond to your enquiry, provide services, refer your file to an RTO, process a payment, verify identity or assist with your pathway.

7. Use and disclosure

7.1 ATSR may use and disclose personal information for the purposes described in this policy.

7.2 ATSR may disclose personal information to:

  • (a) RTOs and CRICOS providers;
  • (b) assessors, trainers and education contractors where relevant;
  • (c) ATSR employees, contractors and agents;
  • (d) IT, CRM, cloud storage, email, SMS, website, booking and document management providers;
  • (e) payment processors, banks and debt recovery providers;
  • (f) professional advisers, including lawyers, accountants, auditors and insurers;
  • (g) regulators, government agencies and law enforcement bodies;
  • (h) employers, referees or industry bodies where authorised or reasonably necessary;
  • (i) complaint handlers, mediators, tribunals and courts;
  • (j) related bodies corporate and business successors; and
  • (k) other persons with your consent or where permitted by law.

8. RTO disclosures

8.1 ATSR may disclose your information to an RTO so the RTO can consider your pathway, enrolment, evidence, RPL, assessment, gap training, complaints, appeals, certification and compliance requirements.

8.2 The RTO will handle your information under its own privacy policy and legal obligations.

8.3 ATSR is not responsible for an RTO’s privacy practices, but ATSR will take reasonable steps to work with reputable providers.

9. Overseas disclosures

9.1 ATSR may use contractors, support personnel or service providers located outside Australia.

9.2 Countries may include [insert countries, for example Bangladesh, India, Philippines, Nepal, United States or other countries actually used].

9.3 ATSR will take reasonable steps to ensure overseas recipients handle personal information appropriately where required by law.

9.4 ATSR must not leave this clause with example countries in the live policy; the actual countries must be inserted.

10. Direct marketing

10.1 ATSR may use your contact details to send information about ATSR services where it has your consent or is otherwise permitted by law.

10.2 Marketing may be sent by email, SMS, phone, social media, messaging platforms or online advertising.

10.3 You may opt out of marketing at any time.

10.4 ATSR will include an unsubscribe facility in commercial electronic messages where required.

10.5 ATSR may still send non-marketing communications, including service, payment, appointment, legal, safety and compliance messages.

11. Cookies and analytics

11.1 ATSR may use cookies, pixels, tags, analytics tools and similar technologies.

11.2 These tools help ATSR understand website use, improve services, measure marketing performance and manage security.

11.3 You can adjust your browser settings to block cookies.

11.4 Some website functions may not work properly if cookies are disabled.

12. Security

12.1 ATSR takes reasonable steps to protect personal information against misuse, interference, loss, unauthorised access, unauthorised modification and unauthorised disclosure.

12.2 Measures may include access controls, passwords, multi-factor authentication, staff training, secure storage, system permissions, contractual controls, backups and secure document transfer processes.

12.3 No method of electronic transmission or storage is completely secure.

12.4 You should not send highly sensitive documents through insecure channels unless ATSR has approved that method.

13. Data retention

13.1 ATSR keeps personal information for as long as reasonably needed for service, legal, accounting, compliance, dispute, insurance and business purposes.

13.2 Retention periods may vary depending on the type of information and the relevant RTO or regulatory requirement.

13.3 ATSR may de-identify or destroy information when it is no longer needed and no legal reason requires retention.

14. Access and correction

14.1 You may request access to personal information ATSR holds about you.

14.2 You may request correction of inaccurate, out-of-date, incomplete, irrelevant or misleading information.

14.3 ATSR may need to verify your identity before responding.

14.4 ATSR will respond within a reasonable time.

14.5 ATSR may refuse access or correction where permitted by law, but will explain the reason where reasonable.

15. Complaints

15.1 You may complain about how ATSR handles personal information.

15.2 Complaints should be sent to the Privacy Contact listed below.

15.3 ATSR will acknowledge and investigate your complaint within a reasonable time.

15.4 ATSR may ask you for further information.

15.5 If you are not satisfied, you may contact the Office of the Australian Information Commissioner where the Privacy Act applies.

16. Notifiable data breaches

16.1 ATSR will assess suspected data breaches in accordance with applicable law.

16.2 If a breach is likely to result in serious harm and notification is required, ATSR will notify affected individuals and the relevant regulator as required.

17. Third-party websites

17.1 ATSR’s website may link to third-party websites.

17.2 ATSR is not responsible for the privacy practices of third-party websites.

17.3 You should read the privacy policy of any third-party website you use.

18. Children and minors

18.1 ATSR’s services are generally intended for adults.

18.2 If ATSR deals with a person under 18, ATSR may require parent or guardian consent.

18.3 ATSR may refuse to collect or process information about a minor without appropriate consent.

19. Anonymity and pseudonymity

19.1 You may contact ATSR anonymously or using a pseudonym where lawful and practical.

19.2 ATSR may not be able to provide services unless it can identify you and verify relevant information.

20. Changes to this policy

20.1 ATSR may update this Privacy Policy from time to time.

20.2 The updated policy will apply from the date it is published on ATSR’s website or otherwise notified.
